Microsoft Says New Xbox One Will Work Without Kinect

The Xbox One?s launch hasn?t exactly gone as originally planned.

Microsoft on Monday said its Kinect motion sensor, which will be included with every new Xbox One purchased, doesn?t have to be plugged in for the new videogame console to work as originally indicated.?The reversal, disclosed in an interview with IGN, was subsequently confirmed by a Microsoft spokesman.

That means customers uncomfortable with a camera in their home constantly connected to the Internet can unplug to make sure no one?s watching.

There were other reasons as well, including situations where the Kinect may be malfunctioning and Microsoft didn?t want to leave the whole Xbox inoperable, the company spokesman noted.

Microsoft?s move adds to the changes to appease gamers that have followed since it first laid out plans for the Xbox One in May.

That initial presentation was panned in gaming circles because the company spent more time talking about TV functionality and other things the device will be able to do other than playing game titles.

In June, Microsoft fueled more criticism by announcing that the new device would need to connect to the Internet at least once per day, while also adding a new restriction on how game disks could be shared or resold. Its $499 price tag didn?t help either.

Sony, besides charging $100 less for its forthcoming PlayStation 4, added none of the restrictions.

Later in June, Microsoft backtracked, stating it would no longer require its Xbox to connect to the Internet each day, nor restrict how its videogame discs are traded, resold or rented.

?We have listened and we have heard loud and clear from your feedback that you want the best of both worlds,? said Don Mattrick, head of Microsoft?s entertainment division at the time.

It did not lower the price, however.

Early the next month, Mattrick jumped ship to Zynga.

Despite the apparent flubs, analysts expect both Microsoft and Sony to enjoy an initial bump in sales when the consoles ship this fall. They are less sure about how long that initial increase will last.

Northern Ireland clashes leave 56 police, 2 civilians injured

By Ian Graham

BELFAST (Reuters) - Fifty-six police officers and two civilians were injured in clashes in central Belfast in the latest flare-up in tensions between Northern Ireland's Protestant and Catholic communities, authorities said on Saturday.

Many of the injuries were minor, but four officers were taken to hospital after the clashes late on Friday, during which police fired plastic bullets and water cannon after being pelted with missiles for a second successive night.

Belfast remains divided between pro-British Protestants and Catholics who generally favor unification with Ireland, despite a 1998 peace and power-sharing deal that put an end to the worst of the "troubles" in the British province.

Protestants tried to block a march on Friday evening along the city's main thoroughfare, Royal Avenue, by the nationalist side of the community and when police moved in to clear them, they threw bricks, bottles and fireworks.

Burnt-out cars and rubble littered the city centre and shop fronts were damaged. Police said seven people were arrested.

"It was sheer thuggery," said Assistant Chief Constable George Hamilton, who commanded Friday night's police operation.

"There were all sorts of weapons and equipment being used against the police including scaffolding and masonry. People were pulling up the paving stones from the busiest shopping precinct in Belfast."

The Catholic parade, marking the anniversary of the 1971 introduction of internment without trial by British authorities, eventually had to pass along a different route.

Eight were hurt on Thursday night when a crowd at a bonfire to mark the anniversary in a Catholic-dominated part of Belfast threw paint bombs, bottles and masonry at police.

Forty-two years ago, soldiers swept into Catholic districts and arrested more than 340 people as the British government sought to halt growing Irish Republican Army (IRA) violence aimed at extinguishing rule from London.

"Last night's violence and attacks on police officers were shameful," Britain's minister for Northern Ireland, Theresa Villiers, said in a statement. "Disorder on the streets is a hugely regrettable step backwards."

In all, more than 3,600 people died in a sectarian conflict that began in the late 1960s, including more than 1,000 members of the British security forces. More than 36,000 were injured.

Dell Inspiron 15 (I15RV-6190 BLK)

Budget laptops are all about sacrifice, but that doesn't mean you have to settle for a big, clunky system with a bland design and limited features. With the Dell Inspiron 15 (I15RV-6190 BLK) you get relatively good performance in a thin, textured 15-inch chassis for under $300. Granted, it uses a watered down version of last year's Ivy Bridge architecture and can't display full HD (1080p), but if you're looking for a solid desktop replacement laptop for emailing, Web browsing, and light home office duty, this deal is hard to beat.

Design and Features
The Inspiron 15 doesn't look like a sub-$300 laptop. Measuring only 1-inch in height it is thinner than both the HP 2000-2b19wm (1.4 inches) and the Toshiba Satellite C855D-S5104 (1.3 inches), and at 5.1 pounds it's also a tad lighter than the Toshiba C855D-S5104. The lid is done up in a stylish textured black finish and sports a shiny Dell logo in the center.

The keyboard deck uses the same textured finish as the lid. The Inspiron 15's matte finish is susceptible to faint fingerprint smudging, though nearly as bad as a high-gloss finish. The full size chiclet-style keyboard is firm, and the black keys travel well, but don't look for backlighting at this price. A numeric keypad sits off to the right, and there's a slightly recessed multi-gesture touchpad with two good-sized buttons at the bottom. The pad has a smooth surface and had no trouble responding to swipe, pinch, and zoom gestures.

The 15.6-inch TruLife display has a resolution of 1,366-by-768 which, means can display 720p HD videos, but it can't display HD content at 1080p. This Inspiron 15 doesn't support touch technology, but again, you'd be hard pressed to find a notebook in this price range that offers either one of these features, let alone both. The display is reasonably bright and offers good color quality, although viewing angles are a tad narrow.

Despite its budget-class status the Inspiron 15 offers a decent feature set, including two USB 3.0 ports and two USB 2.0 ports. As with the Dell Inspiron 17-3721, the speedier USB 3.0 ports are black rather than blue, making it difficult to differentiate between the slower USB 2.0 ports. Other ports include an HDMI video output, a LAN port, and a headphone jack. There's an 8-in-1 card reader on the front edge of the chassis and a 1-Megapixel webcam embedded in the display's upper bezel. Wireless networking components include Wi-Fi (802.11b/g/n) and Bluetooth 4.0 radios.

The Inspiron 15 has 500GB of storage in a 5,400-rpm hard drive and comes with Windows 8 preloaded. It also comes with the obligatory bloatware programs like eBay and Kindle and trial versions of McAfee Security Advisor and Microsoft Office. Dell covers the Inspiron 15 with a standard one-year limited warranty.

Performance
Dell Inspiron 15 (I15RV-6190 BLK) The Inspiron 15 uses last year's Intel Ivy Bridge technology. It is equipped with a 1.8GHz Intel Pentium 2117u processor, Intel's HD Graphics GPU, and 4GB of system memory. It performed pretty much as expected, trailing the faster 1.9GHz Intel Core i3-equipped Dell 17-3721 and 2.4GHz Intel Core i3-3110M-equipped Toshiba Satellite C875-S7340. It blew away the Toshiba C855D-S5104 and HP 2000-2b19wm systems, both of which use a slower, less powerful 1.3GHz AMD E-300 processor.

Dell Inspiron 15 (I15RV-6190 BLK)

We saw similar results across the board; the Inspiron 15 took longer to complete our Handbrake encoding and Photoshop tests than the faster laptops and was almost three times faster than the AMD-based laptops. Likewise, its Cinebench R11.5 CPU score was more than three times higher than the AMD-based systems. Graphics performance was almost identical to the two laptops using AMD Radeon HD 6310 graphics, but none of these systems was capable of handling intensive graphics work. If you want to play the latest games, be prepared to shell out a lot more money for a laptop with a powerful graphics solution.

The Inspiron 15's 4-cell Lithium Ion battery lasted 4 hours 10 minutes on our battery rundown test, which is impressive for a 15-inch desktop replacement laptop. It beat the Dell Inspiron 17 by around half an hour and the Toshiba C875-S7340 by almost an hour and a half. The AMD based laptops had the edge here, however.

With the Dell Inspiron 15 you get a very capable 15-inch laptop at an amazingly low price of $299.99. Granted, it uses older CPU technology and lacks touch-screen capabilities, but it's not a bare-bones laptop by any means and offers enough horsepower to handle the basics, making it ideal for students and day-to-day home office computing. As such, it earns our Editors' Choice for budget laptops.

Obama administration overturns ban on some iPad, iPhones

By Diane Bartz and Ayesha Rascoe

WASHINGTON (Reuters) - The Obama administration has overturned a U.S. trade panel's ban on the sale of some older iPhones and iPads, reversing a ruling that had favored Samsung Electronics Co Ltd over Apple Inc in their long-running patent battles.

The U.S. International Trade Commission in June banned the import or sale of the iPhone 4, iPhone 3GS, iPad 3G and iPad 2 3G distributed by AT&T Inc, saying the devices infringed a patent owned by the South Korean electronics giant.

U.S. Trade Representative Michael Froman on Saturday vetoed the ban, saying his decision was in part based on its "effect on competitive conditions in the U.S. economy and the effect on U.S. consumers." He said Samsung could continue to pursue its case through the courts.

Samsung said it was "disappointed" at the lifting of the ban. "The ITC's decision correctly recognized that Samsung has been negotiating in good faith and that Apple remains unwilling to take a license," it said in a statement.

Apple welcomed the news and applauded the administration "for standing up for innovation." It added, "Samsung was wrong to abuse the patent system in this way."

The Apple products targeted by the ITC ban are more than a year old, though some models such as the iPhone 4 remain solid sellers. Apple sells more than 100 million iPhones annually, but it does not break down sales by models.

Apple and Samsung have been waging a global patent war since 2010, filing multiple lawsuits against each other over the design and functionality of their devices.

This ITC ban is specific to a Samsung patent on technology that allows devices to transmit multiple services simultaneously and correctly through 3G wireless technology.

Such patents are called "standard essential patents" and they cover technology that must be used to comply with standards set by industry organizations.

The Obama administration has been pressing for most infringements of standard essential patents to be punished by monetary fines instead of sales injunctions.

Froman on Saturday said the ITC should thoroughly examine the public interest ramifications of its rulings in disputes over standard essential patents.

Designed to be a trade panel, the ITC has become a popular venue for patent lawsuits because it acts relatively quickly and can order import bans, which are more difficult to get from district courts.

While the ITC was created to ensure that U.S. companies can compete fairly against imports, a number of foreign companies with U.S. manufacturing plants have filed patent complaints with the agency. Samsung has a plant in Austin, Texas.

ITC cases can be appealed to the U.S. Court of Appeals for the Federal Circuit, and from there to the Supreme Court.

Apple has a parallel complaint filed against Samsung at the ITC, accusing the South Korean company of copying the iPhone and iPad. An ITC judge in that case found that Samsung had violated one patent but not a second one. A final decision is due in August.

Samsung makes phones that run on Google Inc's Android operating software, the market leader. Apple has also sued other Android phone makers including HTC Corp for patent infringement.

The case at the International Trade Commission was No. 337-794.

slideshow PERRY, Ga. (AP) ? Michelle Jones is one of the best disc golf players in the country, yet she may not even be the best disc golfer in her own family.

Jones, 41, of Macon, was recently crowned amateur world champion in the masters division at the Professional Disc Golf Association's Amateur Worlds in Emporia, Kan., where she bested a field of 13 other women. The women qualified by getting the most points in official tournaments this year.

But Jones, who has been playing the sport for the past dozen years, said her husband and coach, Clay, is better at disc golf than she is.

"He's way better than me," said Jones, who also won a national title in 2012 in Huntsville, Ala. "He's a professional. I'm just starting to play pro."

Disc golf involves players using flying discs of various sizes and attempting to get them in a basket. Bigger discs that travel farther but are less accurate are known as drivers, while smaller discs that travel short distances but are more accurate are called putters.

Clay Jones noted that his wife actually quit the sport a couple of years ago, because she was frustrated by her short game. But she got back into the sport, working specifically on her putting.

That ended up proving the key to his wife's victory, he said.

"She was the smallest girl there," Clay Jones said. "All of the other girls were outdriving her by 60 feet, but she made all her putts and crushed their wills to live. Her short game is huge for her."

Michelle Jones said much of her training for the recent tournament was almost entirely focused on putting, and even when she's on the course with other local players, she's not really competing as much as she is practicing. She practices every day and plays more than 20 hours a week.

"My focus has changed," said Michelle Jones, who works as a sales representative for 3M.

Even the record rain the midstate has experienced this spring and summer hasn't kept the Joneses from the sport: They added a small putting green inside their house.

In addition to playing competitively, the Joneses have been helping to promote disc golf throughout the midstate. The two of them created the Jones Zen 4 Chains disc golf club, which usually meets at Rozar Park in Perry or at Claystone Park at Lake Tobesofkee. The club now has 50 members and continues to grow, she said.

While organizing the weekly competition at Rozar Park last week, Michelle Jones noted that the sport barely had a presence in the midstate a few years ago, but courses now are popping up all over.

"It's been tremendous," she said. "Five years ago, (the sport) didn't really exist here. Now, there are five courses over the area, and we have new people showing up all the time. A lot of local churches are putting them in, and we're meeting with the Warner Robins Chamber of Commerce to see if we can put a course down there."

The Joneses also have been trying to increase female participation in the sport. Michelle Jones said one of the reasons she has been able to make a bigger mark than her husband is because of the relatively low number of women competing in tournaments. Meanwhile, Clay Jones has had to face thousands of players in his competitions.

One of the members of Jones Zen 4 Chains is 20-year-old Amanda Lockaby, of Macon, who has taken up disc golf over the past few months. She met Michelle Jones through a friend of a friend and currently lives with the Joneses.

Lockaby said training with a world champion has allowed her to progress quickly.

"I wake up in my training center every day," Lockaby said. "(Michelle Jones) helped me with all of it. She demonstrates things and helps me with my form. She tells me what to do. It's worked out pretty well. (Because Michelle is a world champion,) it gives me bragging rights. She's my mentor."

Michelle Jones said she grew up playing a variety of sports, all of which helped her master disc golf. At one point, she was a nationally ranked racquetball player, and she played tennis, soccer and softball growing up.

"It's all about balance," she said. "They're all very similar. It's all interwoven -- the balance, timing, mental game."

Supersonic Dreams
?Stimulated by a 20-month-old British-French plan to build a supersonic commercial jet transport, the Administration has asked Congress to authorize up to $750 million for the development of such an aircraft by U.S. manufacturers. It is felt that the cost of development, estimated at $1 billion, would be too great for private industry. This would be the first time the Government has provided a direct subsidy for the development of a commercial airplane. Najeeb E. Halaby, head of the Federal Aviation Agency, envisions a transport in operation before 1971. Halaby believes it will be possible to produce a craft that is faster than the British-French Concorde and to introduce it at about the same time.?

From Rivalry to War
?In a recent number of La Nature, there appears a critical estimate of the relative air strength of Germany and France. Inasmuch as these two powers have been keen rivals in attaining what may be called a supremacy of the air, an abstract of our French contemporary' article will doubtless prove of interest to our readers. If the actual status of this aerial fleet is secret, that of plans and projects is doubly so. French inferiority is obvious, and also French efforts to diminish that inferiority.?

See a photo album on the art of war in 1913 at www.ScientificAmerican.com/jul2013/warfare

Tsetse Fly
?The Sesse Islands in Lake Victoria are a specimen of Nature' jewelry. But, exquisite as is their scenery, the Sesses form a charnel house. Death is over them. This is a land of silence. The voice of the child is unheard, the chant of Baganda women, so full of cadence, comes no more over the waters. The bark hut villages that for centuries sheltered the finest types of the African race, in mind and body, are rotting ruins. Why this desolation of all that is human? Because of a sleeping death. What causes the sleep that kills? A fly that breeds the tiniest murderer known to the world.?

American Art Abroad
?The London Times says: ?The reputation of Mr. [Frederic] Church, the most eminent American landscape painter, has been brought to this country by his ?Niagara,? and ?Heart of the Andes.? His ?Icebergs off the Coast of Labrador,? now exhibited at the German Gallery, affords an excellent opportunity to form a conception of what landscape painting in the United States is aiming at and achieving. The picture altogether is a noble example of the application of the landscape painter? art to the rendering of grand, beautiful, and unfamiliar aspects of nature, only accessible at great cost of fatigue and exposure, and even at peril of life and limb.'?

The Sun
?If the sun were composed of coal, it would last at the present rate only 5,000 years. The sun, in all probability, is not a burning but an incandescent body. Its light is rather that of a glowing molten metal than that of a burning furnace. But it is impossible that the sun should constantly be giving out heat, without either losing heat or being supplied with new fuel. Assuming that the heat of the sun has been kept up by meteoric bodies falling into it, and proof has been given of such fall, it is possible from the mass of the solar system to determine approximately the period during which the sun has shone as a luminary. The limits lie between 100 millions and 400 millions of years.?

Clothing Machine
?The close competition which exists in some branches of trade renders it necessary that no device or expedient which will facilitate business should be left unadopted. This is particularly true of hoop skirt manufacturing, where so much depends upon the amount and quality of work an operator is able to perform. The skirt frame herewith illustrated is a great improvement upon the old ones in general use.?

Congress: Divided, discourteous _ taking a break

WASHINGTON (AP) ? The accomplishments are few, the chaos plentiful in the 113th Congress, a discourteous model of divided government now beginning a five-week break.

"Have senators sit down and shut up, OK?" Senate Majority Leader Harry Reid blurted out on Thursday as lawmakers milled about noisily at a time Sen. Susan Collins was trying to speak.

There was political calculation even in that. Democrats knew the Maine Republican was about rip into her own party's leadership, and wanted to make sure her indictment could be heard.

Across the Capitol, unsteady bookends tell the story of the House's first seven months in this two-year term. Internal dissent among Republicans nearly toppled Speaker John Boehner when lawmakers first convened in January. And leadership's grip is no surer now: A routine spending bill was pulled from the floor this week, two days before the monthlong August break, for fear it would fall in a crossfire between opposing GOP factions.

A few weeks earlier, Boehner suggested a new standard for Congress. "We should not be judged on how many new laws we create. We ought to be judged on how many laws that we repeal," he said as Republicans voted for the 38th and 39th time since 2011 to repeal or otherwise neuter the health care law known as Obamacare.

Reaching for a round number, they did it for a 40th time on Friday, although the legislation stands no chance in the Democratic Senate and the GOP has yet to offer the replacement that it pledged three years ago to produce.

House Democrats claimed to hate all of this, yet couldn't get enough.

After attacking virtually every move Republicans made for months, they demanded the GOP cancel summer vacation so Congress could stay in session. The break, Democratic leader Nancy Pelosi said, "shows shocking disregard for the American people and our economy."

To be sure, there have been accomplishments since Congress convened last winter, although two of the more prominent ones merely avoided a meltdown rather than advancing the public's preferred agenda.

A closed-door session helped produce compromise over President Barack Obama's stalled nominations to administration posts and important boards ? avoiding a blow-up that Republicans said would follow if Democrats changed the Senate's filibuster rules unilaterally.

Months earlier, at the urging of their leaders, House Republicans agreed to raise the government's debt limit rather than push the Treasury to the brink of a first-ever national default.

Legislation linking interest rates on student loans to the marketplace passed, and, too, a bill to strengthen the government's response to crimes against women. Two more measures sent recovery funds to the victims of Superstorm Sandy.

Among the 18 other measures signed into law so far: one named a new span over the Mississippi River as the Stan Musial Veterans Memorial Bridge, after the late baseball legend. Another renamed a section of the tax code after former Sen. Kay Bailey Hutchison of Texas.

A third clarified the size of metal blanks to be used by the Baseball Hall of Fame in minting gold and silver commemoratives: a diameter of .85 inches in the case of $5 gold coins, and 1.5 inches for $1 silvers.

The Senate passed sweeping immigration legislation to spend billions securing the nation's borders against illegal entry and creating a path to citizenship for an estimated 11 million immigrants currently in the country unlawfully. The vote was 68-32, with all Democrats and about one-third of Republicans in favor.

But House Republicans, many of whom oppose granting citizenship to anyone living in the country illegally, deemed the bill a non-starter. They intend to have alternative legislation this fall. If it succeeds, that will give the two houses about a year to somehow compromise before Congress' term expires.

The Senate approved a bipartisan farm bill that followed customary lines in providing funding simultaneously for growers and for government programs to feed the hungry.

But a revolt by tea party conservatives blocked passage of a combined bill in the House, which then approved a measure to aid farmers. The leadership promises one for nutrition programs this fall, and an attempt will be made to find common ground with the Senate.

So far, Congress' classic two-house compromises have been elusive.

Both houses have approved budgets.

But some Senate Republicans have blocked Democratic attempts to begin compromise talks, saying they will relent only if there is agreement in advance not to raise the federal debt limit as part of any deal.

"Let me be clear, I don't trust the Republicans," said GOP Sen. Ted Cruz, a tea party-backed first-term lawmaker from Texas. "I don't trust the Democrats, and I think a whole lot of Americans likewise don't trust the Republicans or the Democrats because it is leadership in both parties that has got us into this mess."

Indeed, most opinion polls over the past six months put public approval for Congress in the mid-teens, with disapproval generally over 70 percent.

And yet, says Rep. Peter King, R-N.Y., "Congress does reflect the American people and the American people are divided."

Sen. Deb Fischer, a Nebraska Republican who took office in January, said gridlock "is not as bad as I expected," and seems exaggerated by the frenzied 24-hour-a-day news cycle. She said she has been able to agree with several Democrats on amendments to bills in committee.

On a larger scale, though, even prior agreements are endangered. One example:

Under legislation already in effect, spending for one category of federal programs is supposed to total $967 billion for the fiscal year beginning on Oct. 1, with a portion set aside for defense and another share for domestic accounts.

In the House, Republicans approved a budget that adheres to the $967 billion figure but puts more into defense and less into domestic programs than is mandated.

In the Senate, Democrats opted for $1.058 trillion, far in excess of the agreed-upon total.

The difference, about $92 billion, must be reconciled before lawmakers can approve legislation to keep the government in operation after Sept. 30.

Further complicating matters, some tea party-backed Republicans say they will vote for such legislation only if it cancels all funding for the health care law that Congress passed three years ago ? a condition Democrats and Obama vehemently reject.

The alternative to compromise is a partial government shutdown, an outcome leaders in both parties say they can avoid.

But that's a struggle for after vacation.

Energy Drink Makers Fight Off Growing Claims At US Senate Hearing

Senior executives from Monster Beverage, Red Bull and Rockstar told the US Senate's Commerce Committee that they do not pitch their drinks at children, despite their aggressive use of social media and sponsorship of action sports.

"Monster is, and always has been, committed to ensuring that all of the ingredients in its energy drinks, including caffeine, are safe and in regulatory compliance for their intended use," Monster Beverage chief executive Rodney Sacks said.

Energy drinks are a small but growing segment in the non-alcoholic beverage industry in the United States, but health experts have expressed concern that their caffeine content poses risks in youngsters as heart arrhythmia and higher blood pressure.

Last month, the American Medical Association called for a ban on the marketing of energy drinks to children and teenagers, said Senator Jay Rockefeller, the commerce committee chairman, at the start of the hearing.

He stated that in the first six months of this year, poison control centers in the United States received about 1,500 reports involving energy drinks, "more than half of which involved children under the age of 18."

Sitting in the hearing room was Wendy Crossland, who in October 2012 sued Monster Beverage after her daughter Anais Fournier died in December 2011 after consuming two 24-ounce cans of Monster energy drink within 24 hours.

The cause of death, according to the girls' doctors in Maryland, was caffeine toxicity.

In his thick South African accent, Monster Beverage's Sacks argued that, at 160 milligrams, a 16-ounce can of Monster Energy - its best-selling product - had just under half the caffeine of a similar-sized cup of Starbucks coffee.

"The safety of caffeine and other ingredients in Monster energy drinks is well established by an overwhelming body of generally accepted literature published by reputable third parties," he said.

He also stated that Monster's primary demographic is young adult males, and that it "does not focus its brand initiatives on young teenagers" - although a sponsors a so-called Monster Army to support and develop teenaged athletes.

Red Bull North America vice president Amy Taylor said Red Bull products, first launched in Europe in 1987 and now sold in more than 165 countries, are sophisticated premium beverages aimed squarely at adults.

She used Wednesday's hearing to announce that it would limit to 80 milligrams per 8.4 ounces the amount of caffeine in its drinks, and that it would never use child- or teen-oriented characters in its animated "Red Bull gives you wings" advertisements.

But she was caught off-guard when Senator Ed Markey of Massachusetts drew attention to a post on Red Bull's Instagram feed that recommended that consumers wash down a sleeping pill with a can of Red Bull and then "let the battle begin."

"It shouldn't have been messaged," she said.

Rockstar co-owner Janet Weiner said she felt "victimized" by the negative attention being given to energy drinks, but promised - as did Sacks and Taylor - to review her company's social media sites and pull down any posts that encourage unhealthy consumption of energy drinks.

Marcie Beth Schneider, on behalf of the American Academy of Pediatrics, which contends that energy drinks "have no place in the diet of children and adolescents," said that as a doctor, she has met parents who "inadvertently" gave energy drinks to their children to help them perform better in school sports, unaware of the potential health risks.

Another doctor, William Spencer, a member of the Suffolk County council in New York state, said he has personally seen a parent give an energy drink to her 10-year-old at a swim meet. "Many parents think energy drinks are akin to (non-caffeinated) sports drinks," he said.

Suffolk Council is the first municipality in the United States to impost what Spencer called "modest" restrictions on energy drink sales.

Jennifer Harris of Yale University, an expert on food marketing aimed at children, said ads for energy drinks frequently appear on cable channels such as MTV and Adult Swim that have more teenage views than adults watching.

She also noted how energy drinks were early adopters of social media marketing, with teenagers comprising 38 percent of unique visitors to Monster's Facebook page, she said in written testimony.

Senator John Thune acknowledged that caffeine has been consumed for thousands of years, but he noted how it's been turning up in a variety of foods -- not just energy drinks.

"When I hear that caffeine may now be added to products as diverse as potato chips and marshmallows, I have to wonder whether our fascination with caffeine has gone too far," he said.

Potential NBA Trade Scenarios That Would Shake Up the Landscape of the League

Celtics Acquire: Kyle Lowry, Terrence Ross, Landry Fields, two first-round draft picks ($15,138,640)

Raptors Acquire:?Rajon Rondo, Courtney Lee, a second-rounder ($17,179,545)

?

The Toronto Raptors are reaching that stage where they need to make a big move and seize the moment. OK, so maybe it's not much of a moment, but 26-year-old Rudy Gay is either in or rapidly approaching his prime. Hopefully the same goes for 23-year-old DeMar DeRozan, who could form a dynamic wing partner for Gay if everything goes perfectly according to plan.

Meanwhile, the Boston Celtics are hanging precariously in an awkward balance between a robust rebuild and something more subdued. At the moment, Rajon Rondo is still a Celtic. Should Danny Ainge trade away some of those draft picks he's hoarding, he might be able to get Rondo some help sooner rather than later. Maybe there's hope for this season yet.

But unless the perfect opportunity emerges, Boston is better off finishing what they started and taking this rebuild to the next level, sending Rondo on his way to a team trying to win now.

Whether Toronto can win now is one thing, but the franchise does seem to be trying. It wouldn't have bothered getting its hands on the pricey Rudy Gay if it weren't.?The Raptors have enough scoring talent to make use of a brilliant distributor like Rondo, but the real kicker is that Rondo and Gay are the best of friends. Landing Rondo is great, but getting a happy Rondo is significantly better.

That package I have Boston receiving may not wow you for a player of Rondo's caliber, but it gives the organization two things: More draft picks for Ainge to hoard and increased cap flexibility over the next three seasons. Oh and Terrence Ross, could be an absolute stud one day.

Kyle Lowry's modest $6.2 million contract expires after this season, and Landry Fields' expires the summer after that (whereas outgoing Courtney Lee has a third year on his deal, and Rondo's contract is one year longer than Lowry's and pricier at that). That allows Boston to save a little money in the short-term and become more aggressive players in free agency soon enough.

Deals like this will make for a harder fall in Boston, but they should make for a quicker turnaround too.

NY Senate GOP leader complains abortion rights lobbying group allowed to keep donors secret

ALBANY, N.Y. -- New York Senate Republican leader Dean Skelos says the state ethics board dominated by Democrats is giving special treatment to a politically active abortion rights group by keeping its donors secret.

Skelos is demanding that the state Joint Commission on Public Ethics suspend any protection granted to NARAL Pro-Choice NY until it publicly sets policy for granting the exception.

The commission can withhold records of contributors to lobbying groups if the group can show its donors could be in danger.

Its commissioners said this week they want the board to revisit its practice of granting the secrecy without public debate.

Several commissioners said this week that the board has sometimes made mistakes by being too secretive in the past.

The commission had no initial comment Thursday.

3. Thomas5.3 posted on 1 hour ago 3

I wonder how big is the percentage of phones that run a custom rom.. Any way to check that?

4. Sniggly posted on 1 hour ago 1

I expect this holiday season will lead to another big dropoff in Gingerbread usage, and with even budget Android devices at least running decently, I don't think that's going to be the result of a mass exodus to iPhones. We're coming up on the two year mark from the last months of the last year we had new devices on Gingerbread come out. Once we hit April/May of 2014, we'll see the two year mark for the early adopters of the first major ICS phones.

Within a year we can expect Jelly Bean and above to start crushing the market share of older versions, and by that point whoever is left on 2.3 or below is there because they either can't get a newer device or don't really want to.

Post Office mulls booze deliveries to raise cash

Someday...this could be a booze-mobile. A U.S. Postal service employee leaves the loading dock to deliver mail from the Los Feliz Post Office on February 6, 2013 in Los Angeles, California.

Special delivery from the post office ? beer, wine and spirits, if Postmaster General Patrick Donahoe has his way.?

In an interview with The Associated Press, Donahoe said Thursday delivery of alcoholic beverages is on his wish list as the agency considers ways to raise revenue and save money after losing $16 billion last year. He also said he endorses ending most door-to-door and Saturday mail deliveries as a way to help stabilize the service's finances.?

Donahoe said delivering alcohol has the potential to raise as much as $50 million a year. He mentioned how customers might want to, for example, mail bottles of wine home when they tour vineyards. Donahoe said his agency has looked at the possibility of using special boxes that would hold two, four or six bottles and ship for a flat-rate anywhere in the country.?

"There's a lot of money to be made in shipping beer, wine and spirits," Donahoe said. "We'd like to be in that business."?

The Postal Service says mailing alcoholic beverages is currently restricted by law. Customers are even told to cover any logos or labels if they use alcoholic beverage boxes for shipments.?

The agency is also urging changes in how it delivers the mail. A House committee has passed legislation to stabilize the Postal Service's ailing finances that would cut letter deliveries to five days and phase out door-to-door deliveries over 10 years. The bill does not include a provision to allow the agency to deliver alcohol.?

The Senate passed a postal reform bill last year that included a provision allowing the agency to deliver alcohol. The bill would require that such shipments would have to comply with any state laws where the shipment originated and was delivered. The measure also said the recipient would have to be at least 21 years old and would need to provide valid, government-issued photo identification upon delivery.?

The agency faces $15 billion in losses this year and is working toward restructuring its retail, delivery and mail processing operations.?

"We don't want to take any more debt on," Donahoe said. "We want to be able to get profitable, pay it down, just like any other business would, so that you stay strong for the future."?

The service's losses are largely due to a decline in mail volume and a congressional requirement that it make advance payments to cover expected health care costs for future retirees. About $11.1 billion of last year's losses were due to the health care payments.?

Donahoe said over the last decade, the mail volume at his agency's trademark blue boxes has dropped 60 percent.?

"That's our most profitable mail," he said. "That will continue to drop off because people pay bills online. And we understand that, it's easy, it's free, and so we have to continue to make changes."?

On a bright note, Donahoe said the volume of packages the service handles has grown considerably in recent years, a trend he expects to continue.?

The House Oversight and Government Reform Committee recently approved a plan for the service to gradually shift from door delivery to cluster box and curbside delivery, which includes mailboxes at the end of driveways. The agency has been moving toward curbside and cluster box delivery in new residential developments since the 1970s.?

About 1 in 3 mail customers has door-to-door delivery. Some lawmakers have complained that ending home delivery in many densely developed urban areas would be difficult and pose hardships for many people, including the elderly and places where the weather can be harsh.?

"We'd work with the communities," Donahoe said, adding there would be special hardship exemptions for those physically unable to get their mail at centralized locations. "We want to figure out how to do it so people don't get mad."?

Donahoe said there are ways to install centralized mail boxes that fit in well with the neighborhood and also don't cause a lot of hardship for customers.?

Some 30 million residential addresses receive delivery to boxes at the door or a mail slot. Another 87 million residential addresses receive curbside or cluster box delivery.?

Door-to-door delivery costs the agency about $350 per year, on average. Curbside delivery costs average $224 per year for each address, while cluster box delivery averages $160.?

The service earlier this year backpedaled on its plan to end Saturday mail delivery after running into opposition in Congress. It has tried repeatedly and unsuccessfully over the past several years to persuade Congress to approve ending Saturday mail delivery.?

The National Association of Letter Carriers has said ending Saturday delivery would in particular hurt rural residents and the elderly who depend more heavily on the mail for prescription drugs and other goods. Donahoe said there would be a six-month implementation period to help smooth out any problems and that medicines would still be delivered on Saturdays.?

The Senate last year passed a bill that would have stopped the Postal Service from eliminating Saturday service for at least two years and required it to try two years of cost-cutting instead. The House didn't pass a bill.?

FOX: Urban is returning to 'Idol,' J.Lo in talks

He's back! Fox announced on Thursday that Keith Urban will be returning to "American Idol."

Country singer Keith Urban will be back for another season of "American Idol," Kevin Reilly, Fox's chairman of entertainment confirmed on Thursday at the Television Critics Association's summer press tour.

"He did a great job on the show. Fans loved him and you can see how much he loved doing the show," Reilly said.

Reilly also addressed rumors that former judge Jennifer Lopez may be returning to the panel next year for season 13.

"Most of what you're reporting or you read is true. (Lopez) has been a close part of the show all along," he said. "There have been discussions there. There is no deal with her or with anybody else."

Also rumored to be in talks to join the long-running singing competition are season three contestant Jennifer Hudson and "Idol" mentor will.i.am of the Black Eyed Peas.

The panel went through a major shakeup at the end of season 12, when original judge Randy Jackson announced less than a week before the finale that this was his last year on the show. And two weeks after the season wrapped, freshman panelists Mariah Carey and Nicki Minaj quit as well.

Reilly told TODAY.com that though Jackson won't be at the judges' table, it doesn't necessarily mean he's gone from the competition for good. "We're talking to Randy," he said. "I'm sure he'll be back in some capacity ... (as a) friend of the show, certainly guest spots, absolutely."

In 2012, Lopez and Aerosmith frontman Steven Tyler both quit after two seasons on the show. They had replaced Simon Cowell, Ellen DeGeneres and Kara DioGuardi when they all left after season nine. Original judge Paula Abdul left after season eight.

Though there are still three seats to fill for the upcoming season and maybe some changes to make, Reilly said the network isn't planning a massive shakeup.?

"You can?t throw the baby out with the bath water. This is a top five show. There are millions of people who love it as it was," Reilly told reporters. "It needs some recalibration on some things and some fresh new elements. Listen, had 'Thee Voice' never come along and maybe 'X Factor' never been on, we?d be able to have a lot more maneuvering room, but right now we?ve got to keep it fresh and top of the line."

"American Idol" returns for season 13 in January.

1 protester killed in Sri Lankan military shooting

? One person has been killed and about 15 wounded when Sri Lanka's military shot at a protest demanding clean drinking water in a town northeast of the capital.

At least 4,000 protesters gathered in Weliweriya some 12.4 miles (20 kilometers) northeast of the capital Colombo on Thursday. A protester who spoke on condition of anonymity, fearing reprisals, says chemical emissions from a factory into water sources has polluted drinking water in about 15 surrounding villages.

He says police used tear gas initially to break up the protest and when protesters clashed with the police, the army shot at them indiscriminately.

Police spokesman Buddika Siriwardene said one person has died and 15 others hospitalized but declined to comment on the nature of the injuries.

S&P surpasses 1,700 on data, central bank support

By Alison Griswold

NEW YORK (Reuters) - U.S. stocks climbed on Thursday, with the S&P 500 topping the 1,700 level for the first time, after economic data pointed to a modestly improving economy and the Federal Reserve kept its loose money policy in place.

In its latest policy statement on Wednesday, the Federal Reserve gave no hint that a reduction in the pace of its bond-buying program was imminent, as the economy continues to recover but is still in need of support.

Global central banks on Thursday also remained accommodative with the European Central Bank's President Mario Draghi reiterating the ECB's rates will remain at their present level or lower for an "extended period" of time.

Data on weekly U.S. initial jobless claims and national manufacturing came in better than expected, while construction spending dropped 0.6 percent in June, below forecasts calling for a 0.4 percent rise.

"There is an ongoing recovery in the economy," said Leo Kelly, managing director and partner at HighTower's Kelly Wealth Management in Hunt Valley, Maryland.

"It is not an economy that's growing at a break-neck pace, but it's an economy that continues to move forward and that's why you're seeing stocks react positively today."

The market's advance was broad, with all of the 10 S&P 500 industry sectors moving higher. Growth-sensitive financials, industrials and consumer discretionary shares registered the biggest gains.

Bank of America and Wells Fargo were among the companies giving the greatest boost to the S&P 500. Shares of Bank of America rose 2.3 percent to $14.93, while Wells Fargo added 1.8 percent to $44.30.

The Dow Jones Industrial Average <.dji> gained 125.40 points, or 0.81 percent, to 15,624.94. The Standard & Poor's 500 Index <.spx> climbed 16.82 points, or 1.00 percent, to 1,702.55, and the Nasdaq Composite Index <.ixic> rose 36.80 points, or 1.01 percent, to 3,663.17.

Earlier in the session, the benchmark S&P rose to a new intraday high of 1,704.97.

Yelp Inc surged 23.2 percent to $51.47 after the consumer reviews website posted a smaller-than-expected quarterly loss and forecast third-quarter revenue above analysts' expectations.

Pioneer Natural Resources was the S&P 500's biggest percentage gainer after reporting its second-quarter results. The company's shares jumped 13.3 percent to $175.32, after hitting an all-time high of $180.99 earlier in the session.

On the downside, Exxon Mobil Corp dipped 2.2 percent to $91.70, the biggest drag on the Dow and the S&P 500, after reporting a sharp drop in quarterly profit on lower oil and gas output production and weaker earnings from its refining business.

Of the 375 companies in the S&P 500 that have reported earnings for the second quarter, 67.5 percent have topped analyst expectations, in line with the average beat over the past four quarters. About 55 percent have reported revenue above estimates, above the average beat of the past four quarters but below the historical average.

Weekly initial jobless claims data showed a drop of 19,000 to a seasonally-adjusted 326,000, the lowest since January 2008 and better than the 345,000 forecast.

The drop in initial claims, coupled with Wednesday's better-than-expected ADP employment report, bodes well for payrolls data on Friday.

The Institute for Supply Management said its index of national factory activity rose to 55.4 in July, its highest level since June 2011.

Financial data firm Markit said its final U.S. Manufacturing Purchasing Managers Index for July rose to 53.7, the highest since March.

Coburn calls Washington a 'kindergarten'

By Staff Reports on Aug 1, 2013, at 11:08 AM??

WASHINGTON -- U.S. Sen. Tom Coburn compared the nation's capital to a kindergarten Thursday and said he will not be "pushed around" by special interest groups like the ones trying to rally Republicans behind an audacious scheme to stop implementation of the Affordable Care Act.

"We are a mess," Coburn said during an appearance on MSNBC's Morning Joe program. "I call it the kindergarten in Washington."

Coburn, as he often has in the past, went on to lament what he calls a lack of leadership in both Congress and the White House, and a fixation on "political power."

Responding to questions about the blogger Erick Erickson, who attacked Coburn for his opposition to an effort to "defund" the ACA by shutting off funding to the entire federal government, Coburn said "you can't respond to bloggers. ... Unless you agree with them 100 percent of the time you don't pass muster."

Coburn said Edward Snowden, the National Security Agency contractor who leaked classified information to a reporter and then fled to Russia, "is undoubtedly, in my opinion, a traitor."

But, Coburn said, "most of what he knows the Russians probably already know."
